TDIU: How to Get Paid at 100% Without a 100% Rating

Total Disability Individual Unemployability — what it is, who qualifies, how to apply, and how it affects state benefits.

TDIU — Total Disability based on Individual Unemployability — is one of the most underutilized benefits in the VA system. If your service-connected conditions prevent you from working a regular job, you may be entitled to compensation at the 100% rate even if your combined rating is lower.

The Basic Eligibility Requirements

You generally qualify for TDIU if:

  • You have one service-connected condition rated at 60% or higher and can't maintain substantial gainful employment, OR
  • You have two or more service-connected conditions with a combined rating of 70% or higher, with at least one rated at 40% or higher, and can't work

"Substantial gainful employment" means earning above the federal poverty threshold from a regular job. Marginal work or self-employment below that threshold generally doesn't disqualify you.

TDIU vs. Scheduler 100%

There are two ways to receive 100% compensation: a combined rating that reaches 100% through the normal rating formula (scheduler 100%), or TDIU. For benefit purposes, TDIU is treated as 100% for most federal benefits.

For state benefits, it varies. Some states explicitly recognize TDIU as equivalent to 100% for property tax exemptions and other programs. Others require a scheduler 100% rating. Our Benefits Finder accounts for this distinction — we mark which benefits count TDIU as 100%.

How to Apply

File VA Form 21-8940 (Veteran's Application for Increased Compensation Based on Unemployability). You'll need a statement from your doctor supporting the unemployability, and ideally documentation of your work history showing you can no longer work.

P&T Status: The Goal Beyond TDIU

If you're at 100% — whether scheduler or TDIU — you can also seek Permanent and Total (P&T) designation, meaning the VA considers your condition unlikely to improve. P&T unlocks additional benefits including Dependents' Educational Assistance (DEA) and protects you from future rating reductions without due process.
